Top cop’s case back in court

The North Gauteng High Court heard an application on Thursday, October 24, for leave to appeal the judgement on former crime intelligence boss Richard Mdluli.

This comes after Judge Murphy delivered judgment last month, on the Mdluli case brought by Freedom Under Law (FUL) last year.

FUL brought a case against the National Prosecuting Authority and others, for the reinstatement of serious charges against Police Crime Intelligence head General Mdluli.

The lobby group (FUL) won the application last month for a review and setting aside of the decision to withdraw criminal and disciplinary charges against Mdluli.

The National Prosecuting Authority and the police filed an application for leave to appeal the court’s ruling.

FUL did not oppose the applications.

The judge, in his September ruling, also criticised the decision to withdraw fraud and corruption charges against Mdluli.

Mdluli was initially suspended in 2011 amid charges of fraud and corruption, and charges relating to the murder of his ex-lover’s husband.

An inquest the following year cleared him of any involvement in the death of his ex-lover’s husband.

The charges of fraud and corruption were all later withdrawn.

He was reinstated, but was suspended again in 2012, pending a court application to review the withdrawal of criminal and disciplinary charges against him.
