Court in Brief

The following cases were recently finalised at the Boksburg/Vosloorus magistrate’s courts:

Contravening a protection order
• Calvin Sokkalingun (30) of Villa Liza was sentenced to an effective four years behind bars on October 6 for contravening a protection order, malicious damage to property and theft.

He pleaded guilty to contravening a protection order on July 27, last year and not guilty to malicious damage to property and guilty to theft on February 10. Sokkalingun was found guilty of theft on February 10 and the other two counts on August 15.

The protection order was issued on September 5, 2011, and Sokkalingun contravened it by swearing and threatening a woman related to him on May 10, last year.

He also damaged a window and removed her property from her residence without her consent.

He was sentenced to three years imprisonment for contravening a protection order, six months imprisonment for malicious damage to property and six months imprisonment for theft.

Magistrate Cronjé presided and prosecutor Mokwathi represented the State.

• Merrick Campbell (34) of Reiger Park was sentenced to six months direct imprisonment, wholly suspended for five years, and declared unfit to possess a firearm on October 7 for contravening a protection order.

He pleaded not guilty in September last year and was found guilty on October 7 this year.

The protection order was issued on July 6, 2015, and he contravened it on April 19, last year.

Magistrate Mqabele presided and prosecutor Khwela represented the State.

Contravention of the Immigration Act
Kelvin Kwanda (30) of Comet was sentenced to 40 days imprisonment, of which 30 days is suspended for three years, on October 4 for being in the country illegally.

He pleaded guilty to contravening Section 49 (1)(a) of the Immigration Act 13 of 2002 on October 1.

On July 26, the Malawian citizen unlawfully entered and remained in South Africa without being in possession of a valid passport, valid permanent residence or a valid visa and/or not having entered the country at a designated port.

The accused will be deported after the completion of his sentence.

Magistrate Bacon presided and prosecutor Khwela represented the State.

Assault
• An 87-year-old man from Reiger Park was sentenced to three months imprisonment, wholly suspended for five years and declared unfit to possess a firearm on October 6 for assault.

Moses Kosie Abels pleaded guilty and was found guilty on September 20.

On June 26, he hit a woman with a walking stick.

Magistrate Havenga presided and prosecutor Lingani represented the State.

• Gerald Tshaka(40) from Comet was sentenced to an effective three months behind bars on September 14 for assault and being in the country illegally.

The Zimbabwean citizen pleaded guilty to both counts on September 14 and was found guilty on September 14.
On October 3, he grabbed and punched a person.

He was sentenced to 60 days imprisonment for assault and one month in prison for contravention of Section 49 (1)(a) of the Immigration Act 13 of 2002. He will be deported on the completion of his sentence.

Magistrate Havenga presided and prosecutor Khwela represented the State.
