Court in Brief

The following cases were recently finalised in the Boksburg Magistrate’s Court:

Theft
On May 9, Roxanne Horton (38), of Bonaero Park, was sentenced to a R6 000 fine or six months’ imprisonment, suspended for five years, on a charge of theft.

She pleaded guilty, was found guilty and sentenced on May 9.

On February 6, Horton stole cosmetic items to the value of R3 914 from Dis-Chem at East Point Shopping Centre.
In her plea, Horton stated she entered the store with a trolley containing various shopping bags from other stores.

“I went to the East Point Mall to do some shopping. I was pushing a trolley, which contained various shopping bags from other stores in the centre that I had purchased previously on that day.

“I entered the Dis-Chem store and continued to shop for various items. I placed these items on top of the bags that were already in the trolley and also in the dedicated section in the trolley where toddlers/babies are transported. The items mentioned above were not concealed and were in plain view in the trolley.

“I then proceeded to the tills where I unpacked all the items in the toddler/baby section of the trolley, as well
as some items that were on top of the bags in the trolley on the counter for them to be scanned.”

“I did not unpack all the items in the trolley and concealed them with my handbag by placing my handbag on top of the items. I thus did not make payment for various items that remained in the trolley and only paid for the items I unpacked. The items I paid for were valued at R720.70. The items I did not pay for are valued at R3 914.70.

“I then continued to shop in other shops. I was approached by security guards from Dischem while I was in
Pick and Pay who then discovered the items I did not pay for in my trolley,” read a part of her plea.

Magistrate Havenga presided and prosecutor Lingane represented the State.

Assault GBH
On April 26, Morapedi Mahlolwe Mokgaditsi (32) from Primrose Squatter Camp was sentenced to six months’ imprisonment, suspended for five years, on a charge of assault with the intent to cause grievous bodily
harm, and declared unfit to process a firearm.

He pleaded guilty, was found guilty and sentenced on April 26.

On January 15, Mokgaditsi stabbed a man in the head with a knife.

“I was at Caltex garage at about 01:30 looking for containers to recycle. Two petrol attendants approached me and informed me to leave because I made a noise. I refused and they started assaulting me with open hands. As I tried to flee they took my shoes. I then decided to sleep at the garage. As soon as the sun rose, I approached the
complainant and asked for my shoes back. He, however, assaulted me with open hands. I took out a knife and
stabbed him in his head. The police were called and Iwas arrested,” read his plea.

Magistrate Havenga presided and prosecutor Lingane represented the State.

Mokgaditsi has a previous conviction for possession of presumed stolen property, in Nelspruit.

Contravention of protection order
• On May 3, Renee Brown (22) from Reiger Park was sentenced to six months’ imprisonment, suspended for
five years, for contravening a domestic violence order, and was declared unfit to possess a firearm.

She pleaded guilty, was found guilty and sentenced on May 3.

On February 22, Brown entered a residence in Reiger Park despite a protection order against her that prohibited her from entering the property.

The protection order was issued on January 24 in Boksburg and served on February 11.

Magistrate Havenga presided and prosecutor Lingane represented the State.

• On May 3, Calvin Mark Klaasen (49) from Reiger Park was sentenced to three months’ imprisonment, suspended for five years, for contravening the conditions of a domestic violence order.

He pleaded guilty, was found guilty and sentenced on May 3.

On January 10, Klaasen contravened a protection order that prohibited him from assaulting the applicant, threatening her with violence or swearing and insulting her.

“On the day in question I was in Reiger Park. I was residing in the same yard as the complainant, in the back room. I was drinking alcohol, then went into the house. The complainant and I had an altercation, where I started swearing at her. She then called the police,” read a part of his plea. The protection order was served on him on January 14, 2016.

Theft out of motor vehicle
On April 26, Thokozani Thomas (38) was sentenced to 18 months’ imprisonment, of which 12 months is suspended for five years, on a theft out of motor vehicle charge. He was declared unfit to possess a firearm.

He pleaded guilty, was found guilty and sentenced on April 26.

On January 14, Thomas stole a battery charger to the value of R400 out of a parked Renault Scenic in Comet.

“While I was busy taking the battery charger from the boot of the complaint’s car I saw him coming to his car. I ran away and a Makopano security guard chased me until he caught me. The police were called and I was arrested,” read a part of his plea.
