THE owner of a controversial property who contravened city bylaws by tarring and fencing off the property, has agreed amend the development to comply with the bylaws after city officials inspected the property.
The property, located at the intersection of John Zikhali and Stephen Dlamini Roads was highlighted in Berea Mail earlier this month which reported that the original building on the property had been demolished and what appeared to be a large parking lot or car sales lot had been developed on the property.
At the time, Councillor Chris Pappas said the plot had been tarred and fenced and an entrance gate on Stephen Dlamini Road had been installed, something which had not been approved by the municipality.
This land is also zoned residential and not for business purposes. Pappas said a section of the property had also encroached on municipal land.
In response to the outcry over the property, an official acted on the complaint and visited the property this week.
He said he had observed kerbs were being installed and had instructed the contractor to cease with all work with immediate effect which was duly done.

“The owner immediately contacted me as he was extremely concerned of our stance, to which I had explained our requirements to him. He was amenable to our requests and assured me that the fence will be removed and relocated on his boundary, and in addition the tar macadam will be removed and replaced with grass as per the original condition,” said the official.
He said although the owner was not entirely pleased, the municipal requirements stood firm and he would ensure compliance with mandated legislation.
“Essentially work that will be carried out on site will be to correct the non-compliance aspects and will include the installation of kerbs to complete the driveway. I will be meeting with the owner on site and will itemise all our requirements together with timeframes for compliance,” he said, adding that the municipality will continue to monitor the situation until it is resolved.
