SOB resolutions call on council to respect Constitution

Berea residents pledged their support for Save Our Berea's list of resolutions adopted at the Monster Meeting on Tuesday evening.

THERE was unanimous support for a list of resolutions adopted a Tuesday night’s Save Our Berea Monster meeting at the St Thomas Church Hall.

The hall, filled with concerned residents applauded when chairman on the evening and co-founder of Save Our Berea told those in attendance that it was time ordinary citizens to become activists and to get angry about what was happening in their towns and cities.  He received overwhelming support when he called for a mandate from residents for the resolutions to be adopted.

The resolutions adopted were:

1. That the eThekwini Municipality and all City Councillors, regardless of their political allegiance, respect the South African Constitution in all decisions taken by the Council and in all debate conducted in arriving at decisions taken.

2. That is the duty of the Speaker of the eThekwini Council and the political party caucuses to discipline members who do not abide by the South African Constitution and especially the Bill of Rights.

3. That the eThekwini Municipality take the issue of rampant corruption seriously by encouraging the public and staff to report corruption, which reports can be made confidentially, given the physical risk to “whistleblowers” in South Africa.

4. That given that the function of the City Integrity and Investigations are:

• To promote respect for human rights and to cultivate a culture of human rights within the eThekwini Municipal area;

• To investigate any conduct, in the affairs of eThekwini Municipality, that is alleged to be improper or to result in any impropriety or prejudice, including maladministration, corruption, and abuse of power, undue delay and unfair discrimination.

That it is our opinion that this department is not adequately doing it’s job and should be transparent in reporting back to the citizens and the staff of the municipality, on its actions.

5. That SAVE OUR BEREA, be mandated to use its legal contacts to investigate the possibility of a “class action” to recover taxpayers money where officials or elected representatives are found to be negligent or unlawful with the spending of public money.

6. That the eThekwini Municipality instigate an investigation into the Land Use Management and building plan approval departments to ensure that the process is done to the letter of the law, that plan approval is speeded up to make eThekwini a desirable investment destination, and that an elevation control mechanism is re-introduced.

7. That the eThekwini Municipality must abide by the provisions, and especially Section 7, of the National Building Regulations and Building Standards Act no 103 of 1977, and also take cognizance of judgments made by the Appeal Court of South Africa.

8. That SAVE OUR BEREA, be mandated to engage with AMAFA to make the heritage conditions simpler and more user friendly
