Former police captain guilty of culpable homicide

Prebashan Moodley shot and killed his friend, Kevin Maistry, while intoxicated.

A former police captain who shot and killed his friend while socialising at a braai in Asherville was found guilty of culpable homicide in the Durban Magistrate’s Court this week.

The 52-year-old, Prebashan Moodley, shot his friend, Kevin Maistry (53), while arguing about soccer teams. It is believed he was intoxicated at the time.
Moodley pleaded guilty and was convicted of negligence in handling a firearm under the influence of alcohol. He alleges he had been aiming at beer cans on the side of the braai stand.

After hearing conflicting evidence from two state witnesses, magistrate Delia Turner found that Moodley did not intend to kill when he opened fire. In an earlier appearance, Moodley’s defense, advocate Jimmy Howe, alleged Moodley was intoxicated at the time and the shooting was an accident.

Moodley’s attorney called for an adjournment in sentencing until he submits a correctional supervision report. Magistrate Turner adjourned the case until late February.
