AKA murder suspect says State is ‘skating on thin ice’
This morning, as the court moved forward with the bail hearing, they heard from three of the accused.
THE five suspects being held in Durban in connection with the killing of Kiernan ‘AKA’ Forbes and Tebello ‘Tibz’ Motsoane, which occurred on Florida Road over a year ago, were back in court this morning (March 14).
Three of the five accused submitted their affidavits which detailed their backgrounds and included points that were posed to the court as to why they should be granted bail.
One of the accused, Lindokuhle Mkhwanazi, outlined the responsibilities he has been unable to tend to while being detained – as a taxi owner with a pregnant wife at home.
In his affidavit, Mkhwanazi denied his involvement in the murders, stating that the state is ‘grasping at straws’.
“The state is skating on thin ice as they do not have evidence linking me to the offence or the offences,” said Mkhwanazi in his affidavit submitted to the court.

Mkhwanazi went on to detail his arrest last December, disclosing that officers stopped him while he was driving and detained him concerning another case with similar charges.
He alleges that during interrogation, detectives suggested to him that he may have been involved in the murders of Forbes and Motsoane. He says he immediately denied any involvement in the double murder.
The 30-year-old taxi owner said he believes he will not be found guilty and intends to apply for a discharge of the charges. He also stated that he brings home a salary of R40 000 a month and hopes to be granted bail to return home to his pregnant wife.

Lindokuhle Thabani Mkhwanazi (30), Lindani Zenzele Ndimande (35), Siyanda Eddie Myeza (21), Mziwethemba Harvey Gwabeni (36) and Lindokuhle Lindo Ndimande (29) are facing charges of conspiracy to commit murder, the murder of Forbes, the murder of Motsoane, unlawful possession of a firearm, unlawful possession of ammunition and five counts of attempted murder.
Ndimande and Gwabeni did not proceed with their bail application as they were not ready due to pending amendments to their affidavits. The five suspects will continue to be held in Durban while the state works on extraditing the two other accused, Siyabonga Gezani Ndimande and Malusi Dave Ndimande, from eSwatini.
The case is due to resume on Monday, March 18.
