Advice for Airfield residents — Follow the Money

There is an old adage: Follow the Money.

There is a provision in South African law that will scupper this whole process.

When a developer lays out a township such as Airfield, the applicable town planning regulations come into force. The developer has to provide at his own expense:

· Roads.

· Parks, apart from services such as sewers, electricity and water.

If a road or park is sold for other use by the local authority then the proceeds thereof belong to the developer or the heirs of the developers.

The money does NOT belong to the local municipality.

This is for the very simple reason that these were GIVEN to the community and remain the property of the community until their designation is changed.

If the designation changes, then they revert to the original developer. (This is a tenet of the old Roman Dutch law that has governed this country and Botswana for a very long time.)

So now, if the municipality or anyone else is prevented by law from benefiting from the sale of public amenities originally provided for free, then these developments will not take place. Follow the money and have the law enforced!
