Golf club denies responsibility for damaged car

On October 21, I was travelling on Main Road, towards Boksburg.

Before reaching the robot I suddenly saw a white object flying towards my car.

I realised at the last second that it was a golf ball; it hit my car twice.

When I inspected my car, I found that the ball had cracked the cover of my side mirror.

This will cost me a few thousand Rand to replace.

I immediately drove to the Lake Club Benoni and related the incident to Andrew Bromley, the manager.

He emphasised three times during our five-minute conversation that they were not responsible for the people playing at the club.

He was also not prepared to interrupt the players playing in the area where the ball came from until they finished their game, to see if anyone was prepared to accept responsibility.

I have never heard from him again.

The Lake Club Benoni most certainly has a responsibility according to the law, and the by-laws of Ekurhuleni, towards protecting people and property on and off their property against injury and damage from the business conducted on their premises.

As I am not the first and won’t be the last person with damage to property from a golf ball from the Lake Club Benoni, I invite anyone with the same problem to contact me, so that we can ensure that this does not happen again.

I appreciate your frustration related to the costs and inconvenience that you have incurred since the alleged incident.

As a club, however, we are not in a position to accept responsibility for the actions of those people who play on our course.

I, personally, made attempts to establish who had struck your car with a golf ball, but these were unsuccessful.

Had we found the responsible individual, we would gladly have extended the courtesy of trying to arrange a meeting between him or her and yourself to see if an amicable arrangement could be met.

Regrettably, this was not possible.
