The organisation approached the court to determine whether the Ekurhuleni Metropolitan Municipality (EMM) is in contempt of court following a court order made about the Benoni Bunny Park.
The last court order, dated June 30, said the EMM needed to do the following within a month of the order:
• Carry the costs of additional veterinarians required to sterilise the animals.
• Pay to medically treat sick and or diseased animals by qualified veterinarians.
• Pay to feed the animals and provide adequate nutrition for the animals.
• The metro must isolate sick, diseased and injured animals from the healthy ones until the sick, diseased and injured bunnies have been medically treated and or humanely euthanased where a professional determines that medical treatment would be futile.
“Our legal papers were not in order and the judge appeared not to be sympathetic towards the plight of the animals,” a Bat Facebook post said on the day of the court’s decision.
“The previous court order still stands and EMM has to comply with this.
“Team Bat wants to hold EMM accountable for the animals in their care.
“By following through with this legal case, we are setting a precedent for future cases of a similar nature.
“At some point, the legal system has to work in favour of the animals. We were hoping that this would be that point.”
Bat said it would update the public on the way forward in terms of a new court application.
