Court hears details of shooting

Retief Liebenberg is severely traumatised and is suffering from an acute stress disorder - leaving him anxious and depressed - the Benoni Magistrates Court heard on Friday, last week.

These findings were presented to magistrate Ian Cox and made by a professor in clinical psychology, after consulting Liebenberg, at the Benoni Police Station.

The findings stated that the accused has been under stress since 2012.

This emanates from his daughter, Chevonne Liebenberg (20), twice receiving rehabilitative treatment for a drug addiction.

It also attributed the stress to her dropping out of university

These findings were read to the court by defence advocate Marius van Wyngaardt, in support of his client’s bail application.

Liebenberg made his second appearance in court on November 8, for a bail application.

The matter was postponed and he is expected in court on Friday, November 15, for the continuation of his bail hearing.

He is currently being detained at the Benoni Police Station.

He is accused of shooting dead Dewalt “Poenie” Visser (20), and his father, Dewalt Visser Snr (46), at the accused’s home at the Ebotse Golf and Country Estate, on October 31.

The court heard that at least seven people were in the house at the time of the shooting.

These include Liebenberg, his brother Richard, his daughter Chevonne, the accused’s girlfriend, the two deceased and a friend of Visser Snr, identified as “Rocco”.

The investigating officer in the case, WO Peter Mbonani, said in court, on Friday, that police were not able to obtain a statement from Chevonne, as she is still severely traumatised by the shooting.

Her statement is believed to be a key aspect in the investigation.

The funeral of Poenie and his father was held at the Christian Family Church, in Bonaero Park, on Friday, November 8.

Aspects of Liebenberg’s affidavit which were presented to the court:

The court heard, in Liebenberg’s affidavit, that he was severely provoked by Poenie and his father, Visser Snr, at the house, before and during the shooting.

He said he was attacked by both the deceased and said “extraordinary factors played a role in the incident”.

He is the sole owner of Super Sound and Accessories, in Springs.

Liebenberg said not being granted bail will have a negative impact on his business, as well as on his children.

He has been advised that his children have been affected by the news of the incident.

Liebenberg does not want to lose touch with his children, as he is close to them.

He supports them emotionally and financially and said they will suffer emotionally and financially if he is not granted bail.

His ex-wife, Lizelle Carter, is supporting him through the ordeal.

His brother, Chris, offered to house him if he can’t return home if he is granted bail.

Investigating officer WO Peter Mbonani’s testimony:

It is believed that Poenie was at a friend’s house at Ebotse on the day of the shooting and waited until Chevonne was home before he went to her house.

He arrived at Liebenberg’s house at 3pm, possibly to visit Chevonne.

Poena is believed to have called his dad to the house at Ebotse.

Visser Snr was apparently visiting a friend and got a call from Poenie to come to the house at Ebotse.

Visser Snr asked his friend to accompany him to Liebenberg’s house.

Visser Snr hit Liebenberg with a fist shortly after arriving at the house.

The matter was apparently resolved and the deceased were going to leave the premises.

Liebenberg went out of house and went to the back of house to the garage, with Poenie and his father still alive.

Liebenberg then came back and started shooting from outside the house (the defence said no casings were found outside the house). Mbonani said this is why he believes the scene was tampered with. Police are still awaiting the ballistic report.

The shooting occurred at 7pm, after the accused followed Poenie and shot him as Poenie ran towards the kitchen.

Mbonani believes the scene was staged, because there were more bullet wounds than cartridges, but he is not sure who would have staged the scene (Mbonani only arrived on the scene several hours after the shooting).

Mbonani said it would be in the interests of the accused’s safety to be kept in custody.

He is scared the accused will contact Chevonne while on bail.

Statement from Liebenberg’s brother, Richard

According to the statement, there was an argument between Chevonne and Poenie in an upstairs room in Liebenberg’s house.

Poenie then allegedly threatened Richard.

Visser Snr arrived at the house at Ebotse and threatened Richard.

Visser Snr then tried to hit Richard with a fist in the house, but missed.

Poenie’s father then hit Liebenberg with a fist.

Shortly after the scuffle Chevonne fell to the ground.

Liebenberg then knelt down and was allegedly assaulted by the deceased.

The accused then fired shots at them.
