EMM welcomes ConCourt judgment

The municipality has welcomed last week’s Constitutional Court judgement that three metropolitan municipalities may no longer hold new property owners liable for outstanding monies owed by the previous owner or entity.

“The City of Ekurhuleni welcomes the ConCourt judgment,” said the Ekurhuleni Metropolitan Municipality (EMM) spokesperson Themba Gadebe.

“The city will continue with debt collection, except now a new owner will not be held liable for the debts of the previous owner.

“We will look at a practical implementation of the judgment and reconsider the debt collection process.”

In a press release, the New Ventures Consulting and Services (Pty) Ltd trading as the Municipal Debt Specialists (MDS), a company specialising in the analysis and verification of municipal debts, said they initiated, drove and paid for all litigation when it became apparent that several municipalities were holding previous home owners liable for outstanding debt.

The application was brought against the EMM and the City of Tshwane.
