Mido Macia case draws to a close

Sentencing procedures in the murder trial of eight former Daveyton police officers, who were found guilty of the murder of Mozambican taxi driver Mido Macia, will begin on September 22.

After a four-week trial, the North Gauteng High Court found all the accused guilty of murder, on August 25.

Judge Bert Bam ruled that all the policemen had known Macia was being dragged and realised he could be seriously injured and die, but did nothing to assist him.

The prosecution had asked for the accused’s conviction on a charge of murder, on the basis of dolus eventualis, but the defence argued that the state had failed to prove either culpable homicide or murder and that the former policemen should be acquitted.

Meanwhile, the state has now offered to compensate Macia’s family, after disputing the claim earlier in the trial.

Macia died in a police holding cell on February 26, 2013, several hours after he had been dragged by the van.
