ActionSA lays charges against Ekurhuleni MMC for violating traffic acts

ActionSA said these allegations were serious and the National Prosecuting Authority must test them.

ActionSA councillors in Ekurhuleni, led by the caucus leader Clr Siyanda Makhubo opened a criminal case against the EFF MMC for Finance Nkululeko Dunga, at the Germiston Police Station on November 3.

This was prompted by the allegations following the car crash that claimed one life and in which the MMC’s blue light motorcade was involved.

“ActionSA has been reliably informed the vehicle involved belongs to a prominent businessman who was recently awarded tenders in the City of Ekurhuleni (CoE).

“Added to this, the vehicle was fitted with state security detail including blue lights, which contravenes several laws and policies of the CoE, specifically for public office bearers,” said Makhubo.

The EFF has since called the allegations ‘baseless and untrue.

He said these allegations were serious and the National Prosecuting Authority must test them.

Makhubo said if Dunga is found guilty, he should be removed from his position.

Another party that has opened a case against Dunga is the ANC Youth League in Ekurhuleni, led by the ANC Youth League regional executive committee. They opened the case at Kempton Park Police Station.

Both cases are about violating Regulation 176 of the National Road Traffic Act (93 of 1996).

This regulation states it is illegal to operate a motor vehicle equipped with a blue light or a lamp that emits a blue light, except for vehicles driven by members of the SAPS or Municipal Police Service, traffic officers, or members of the South African National Defence Force (SANDF) performing police functions.

Both parties have said accountability is needed and such reckless behaviour would not be tolerated.

GCN spoke to EFF provincial communications officer, Dumisani Baleni, who said all these allegations were baseless.

“We are not surprised by this behaviour. Election season is coming and people are politicking. All these allegations are not true. The rumour of a private car fitted with blue light is not true,” said Baleni.

“People are making allegations about Dunga and a businessman to whom the CoE has recently awarded tenders. They must provide the name of this person so we can look into it. The MMC has the right to be friends with whoever he chooses,” said Baleni.

He further said EFF leadership in Ekurhuleni has been under attack since they came into power.

“The EFF is doing well in their positions and improved things since taking over from the DA.

“As EFF we are not going to entertain baseless rumours with no proof. People need to produce proof of the allegations they are making,” said Baleni.

He said the EFF is focusing on the recovery of the MMC.

GCN requested comment regarding the allegations made from the office of the executive mayor Sivuyile Ngodwana, CoE, EMPD, the finance department and Dunga’s office.

Ngodwana acknowledged receiving the enquiry on November 3 and said they are looking into the matter.
No further comment was received by November 6 at 9:00.
