Bid to nullify city manager’s contract fails

An application to invalidate the Ekurhuleni City Manager’s employment contract failed at the South Gauteng High Court on August 13.

An application to invalidate the Ekurhuleni City Manager’s employment contract failed at the South Gauteng High Court on August 13.

The court declined to declare the extension of the city manager’s contract unlawful and invalid.

The court also declined to review and set aside the Ekurhuleni Metropolitan Council’s resolution extending the contract of the city manager.

Ekurhuleni spokesperson, Mr Themba Gadebe, said the matter has been referred to the Gauteng MEC for Housing and Local Government for consideration within 10 days from the date of judgment.

“The effect of the court order is that the resolution of council of September 27, 2012, and the extension of the city manager’s contract is for all intents and purposes lawful, and the city manager continues to perform his duties as the accounting officer of the municipality, ” said Mr Gadebe.
