CoE urges local liquor traders to comply with its by-laws

The stipulated laws are meant to prevent the contravention of several acts regulating the liquor industry.

The City of Ekurhuleni calls on tavern owners to comply with the city’s by-laws and policies for a safer environment for neighbouring residents and customers.

According to CoE, taverns which are defined as part of a dwelling house or a shipping container used for the sale of liquor for on-site consumption, are meant to be governed by the town planning scheme of 2021, spatial planning land use management bylaw of 2019, the national building regulations and building standard act 103 of 1977(as amended) and the Gauteng Liquor Act 2 of 2003 among other legislative requirements.

The CoE stated that land uses not approved through the city’s processes, give rise to challenges of the inability to monitor security, mushrooming of illegal land use activities, the structural safety of buildings comprising the safety of patrons and neighbours, noise pollution and the unauthorised use of municipal services which impact on infrastructure maintenance and costs.

“Tavern applications can be considered where the residential or business property has the necessary rights and the building plan is in compliance with building regulations,” said CoE spokesperson Zweli Dlamini.

CoE encouraged tavern owners to visit their nearest customer care centre and engage officials in the town planning and building control department for more information.

Where building plans are required, the plans must be drawn by a registered architect.

Applications will be considered for approval based on compliance with policies and applications must be prepared by a qualified town planner.
