If you got a fine in the last nine years, there’s a strong chance you don’t have to pay it if you haven’t yet, The Citizen reported on 27 February.
Fines issued under the Administrative Adjudication of Road Traffic Offences (Aarto) Act since 2008 must be scrapped where authorities did not comply with the act’s conditions, such as infringement notices and other documents issued under the act must be served through registered mail.
The North Gauteng High Court ruled on Friday that traffic authorities have to abide by the letter of the Aarto Act, and ordered that the fines before the court must be cancelled.
The ruling came after Fines4U, a company that specialises in the legal reduction of traffic fines, initially approached the court.
The Citizen said Tshwane Mayor Solly Msimanga recently said Tshwane and Johannesburg were considering withdrawing from Aarto.
“They are the only two cities where the act has been implemented on a trial basis and has been plagued with problems.”
