DIRECTIVE ISSUED: NOTICE OF APPLICATION FOR RECTIFICATION APPLICATION IN TERMS OF SECTION 24G (1) OF THE NATIONAL ENVIRONMENTAL MANAGEMENT ACT 107 OF 1998 (`NEMA`) AS AMENDED: UNLAWFUL COMMENCEMENT OR CONTINUATION OF A WASTE PLASTIC RECYCLING FACILITY ON ERF 568, 211 LINTON JONES STREET, GERMISTON SOUTH, GP Notice is hereby given in terms of Section 24(G) read together with sections 24(F) of the National Environmental Management Amendment Act (as amended), and is for ex post facto authorization in respect of the illegal activities, that the Gauteng Department of Agriculture and Rural Development:
a)is considering an application for rectification by ACME Recycling (Pty) Ltd in terms of Section 24(G)
and 24(F) of the National Environmental Management Amendment Act (as amended); and
b)for the unlawful commencement or continuation of listed activities in terms of section 24G of the
National Environmental Management Waste Act (No 59 of 2008) by the waste plastic recycling facility on Erf
568, 211 Linton Jones St., Germiston South, GP, for:
Activities unlawfully commenced with in terms of the NEMWA, 2008 promulgated in terms of the NEMA, Act No 107 of 1998 on/after 11 October 2017
oCategory A: Activity 3: Recylcing of general waste at a facility that has an operations area in excess of 500m, excluding recycling that takes place as an integral part of an internal manufacturing process within the same premises, and
o Category C: Activity 5: A person which wishes to commence undertake or conduct a waste
management activity listed under this category must comply with the relevant requirements or standards by the Minister as listed below. –
a.Norms and standards for the storage of waste 2013
b.Norms and standards for the sorting shredding grinding crushing screening or bailing of general waste. 2017.
`Activity details: This portion of a land falls within the suburb of Germiston South, Ekurhuleni
Metropolitan Municipality Gauteng Province. Entrance to site: Street address: Erf 568, 211 Linton Jones St.,
Germiston South, Province of Gauteng. The total area of Erf 568 is ~6 068m. The activity entails Recycling of plastic materials by means of shredding, melting, extruding, cooling and chopping it into pellets.
