Murder accused bail judgement to be heard on December 20

The six accused of the murder of Babita Deokaran appeared briefly in the Johannesburg Magistrate’s Court on December 9.

The matter was postponed on November 2 for the court to receive clarity about the nationality of the third accused in the matter, Phinda Ndlovu.

The State indicated that the investigating officer did contact the Department of Home Affairs but the process could not be completed as they needed a fingerprint from the accused to match with their system.

The defence read an affidavit by Ndlovu’s mother into the record stating that she is a South African resident and that he was born in Kwazulu-Natal.

The matter of the accused’s nationality was considered resolved by the agreement of both parties.

The magistrate requested a postponement of at least a week and a half for him to complete his judgment in the bail application of the accused. The matter has been postponed to December 20.
