Eviction ordered by High Court

The eviction of the Taylor family, reported in the RECORD of March 26, was a legal eviction, ordered by the South Gauteng High Court, Johannesburg.

EDEN PARK -The eviction of the Taylor family, reported in the RECORD of March 26, was a legal eviction, ordered by the South Gauteng High Court, Johannesburg.

In last week’s report, Joseph Taylor claimed that he had been in and out of court since November 2013, that he was illegally evicted and that his water and electricity meters where not working.

The property in question was a property in re-possession at the bank, which the new owner bought through the bank, with a bond. He has been paying the bond and insurance on the property for the past five years.

Taylorā€™s statement about the water and electricity meters relate to the fact that his water and electricity account is also in arrears.
Further the RECORD established that Taylor and his family were given the opportunity to rent the property from the new owners, however, it is said that the Taylors rejected the offer, and never paid rent and utilities for about five years.

Due to the non-payment of rent as well as water and electricity accounts, the rightful owner of the property, once again referred to case to the court for judgement. The eviction order was given as result of the non-payment of rent to the rightful owners of the property. The rightful owner has to date lost about R220 000.00 in terms of rental income, bond and utility payments, legal costs, and the right to live in his property.

A member from the Sherrif’s office in Alberton told the RECORD that, in the case of owner against Mr Taylor, papers and notifications of court appearances and the fact that there is a civil case, has been served upon the Taylors since February 26, 2013.

The last order served on the Taylors, was that of eviction on March 13, when the property was handed over to the new owner.
Should Taylor not adhere to this eviction, he could face criminal charges of trespassing and contempt of court.
