Graphic photographs: Murder accused declared unfit to stand trial

Rocky Kabeya believes the murder accused is acting.

It’s been four years since Martine Kidiongo’s brutal death when she was butchered and stabbed 15 times by William Biney (Willy) in front of her children in Rosettenville.

At the time, Biney accused Kidiongo of stealing R15 000 where he used to live.

The family of Kidiongo just learned that Biney was sent to a psychiatric hospital because he was unfit to stand trial. She was killed on March 24, 2017.

Rocky Kabeya, Kidiongo’s husband, and Cherry Amij Tshibamba, the brother-in-law, said they are angry because Biney caused them so much pain.

“Four children, Blessing Ntumba (11), Angel Kidiongo (nine) and twins Joshua Mukendi and Ruth Luabeya, who are both six, are left without their mother.”

Tshibamba said all they know is that Biney was ordered by court to undergo psychiatric evaluation.

“We are not sure where he is now. All we know is that in court, we heard that after psychiatric evaluation, he will be deported to Ghana. No one is communicating with the family on this issue,” he said.

On the other hand, Kabeya expressed his anger and agony on this matter.

Butchered woman’s case continues

“I’m struggling to make ends meet. I have four children that I need to take care of. The twins don’t have birth certificates and I’m struggling to get them to school. Every day is traumatic for us.

“I am very disappointed. This proves that justice does not exist in this world. How come a normal person who took three weeks to plot how to kill someone and succeed, someone who’s most suspicious things reported by police had been found in his room and had many identities, which proves he is a mafia.

“Someone who told me I shouldn’t waste my energy because he is going to get out of jail soon and continue with his mafia things, so now I have to believe he is mentally ill? No!

“Even the court told me not to bother to bring a lawyer because it was the business of the government justice since the murderer was caught on the spot, but now the justice says that the case was closed, without paying him penalties.

“Not even legal assistance was offered to the victim’s family, although it will not bring back my wife. Does justice care about the victims? Or all we can get is the loss of a loved one, negative justice and daily trauma?

“Of what justice does it serve me and my family that a murderer gets nothing but a slap on the wrist? It is simple for one to play a mad man after taking the life of another human being, we know this as acting,” explained Kabeya.

Moffat View SAPS communications officer Sgt Solly Matjila said, “On March 22, 2019, the suspect appeared in the Johannesburg Magistrate’s Court and was declared unfit to stand a trial. He was referred to Sterkfontein Psychiatric Hospital and was admitted as a State patient. The matter was finalised and the case was closed.”
