Another postponement for double murder trial

Double murder trial faces more delays in the new year.

Springs – On Tuesday morning the court heard more reasons why the murder double trial could not move forward.

Once again, Court C of the Springs Magistrate’s Court was filled with frustrated community members who came to support the families of slain Refiloe Moshime and Thuto Theko.

The KwaThema businessman, who is out on bail for their murders, appeared at the same court on July 19, 2017, where the case was remanded.

It is alleged that on April 14, 2017, the man shot and killed Mosime and Theko.

This time the defence attorney claims he asked the then head investigating officer if he had “anything in writing.”

In the previous sitting, the court heard that the docket had remained with the courts, hindering any further investigation.

The investigating officer says he still has no instruction from the Director of Public Prosecutions (DPP).

In the last court sitting for the case, the magistrate made it clear that September 20 would be final date of postponement.

The investigating officer promised to push his department harder to ensure that they keep to the set date.

But on September 20, 2017, there were more delays.

And the magistrate advised the IO to go to the DPP in person and request the docket.

“I need some indication, some guidance,” added the magistrate.

She gave him until 12noon to go to Pretoria so that the proceedings can continue.

However, the matter ended up being postponed to January 30.

And on this day, the matter was again remanded to March 14.
